("ASA" "the Organization") respectfully requests abatement of any late filing penalties assessed in connection with the Form 990 for the tax year ended July 31, 2025. The late filing was caused by circumstances beyond the Organization's reasonable control, as described below. Background: Angiosarcoma Awareness, Inc. is a small 501(c)(3) nonprofit organization dedicated to raising awareness of and supporting research into angiosarcoma, a rare and aggressive form of cancer. The Organization is governed by a two-person volunteer board of directors and has no paid employees. All administrative and financial functions, including the preparation of this Form 990, are performed on a volunteer basis. Circumstances Causing the Delay - The filing delay was directly caused by the corruption of the Organization's QuickBooks Desktop backup file, which rendered multiple years of financial records inaccessible. This data loss required the complete reconstruction of the Organization's financial records from primary source documents. Specifically, the volunteer preparer was required to perform the following work before the Form 990 could be accurately prepared:* Complete bank and credit card reconciliations for fiscal years 2021 through 2025, working from original bank statements and credit card records. * Re-entry of all transactions into a new QuickBooks Online environment, spanning approximately four fiscal years of activity. * Preparation of adjusting journal entries to reconcile the reconstructed records to previously filed Form 990 returns for fiscal years 2023 and 2024. * Reconstruction of investment account records, including reconciliation to custodian statements for KeyBank and RBC investment accounts. * Preparation of a five-year contribution history for Schedule A public support testing, requiring review of transaction-level records back to fiscal year 2021. This reconstruction effort was substantial and time-consuming, particularly given that it was performed entirely on a volunteer basis alongside the preparer's other professional obligations. Despite working diligently to complete the return as promptly as possible, the scope of the required remediation made it impossible to file by the extended due date of June 15, 2026.Angiosarcoma Awareness, Inc. has maintained a consistent record of timely compliance with its annual filing obligations. The Organization filed Form 990-N for fiscal year 2024 and has not previously been assessed a late filing penalty. Based on the foregoing, Angiosarcoma Awareness, Inc. respectfully requests that the Internal Revenue Service abate any late filing penalties assessed for the Form 990 for the tax year ended July 31, 2025. The delay was caused by the unforeseen corruption of the Organization's financial records - a circumstance clearly beyond the Organization's control - and not by willful neglect or disregard of filing obligations. The Organization acted in good faith and with reasonable cause throughout the remediation and filing process. In the alternative, if the Service does not grant abatement on reasonable cause grounds, the Organization respectfully requests consideration of first-time abatement relief under IRM 20.1.1.3.6, given its clean penalty history.
