The only supported organization for the Tennessee Arts Foundation is the Tennessee arts Commission; therefore, the IRS concluded that the Tennessee Arts Commission has status under sections 509(a)(1) or (2). Schedule A, Part IV, Section D, Line 3 Schedule A, Part IV, Section D, Line 3 - The bylaws of the Tennessee Arts Foundation assure that its supported organization, the TN Arts Commission, has a significant voice in the organization's investment policies and in directing use of the organization's income or assets at all times during the tax year. Specifically, the bylaws state that "the Board of Trustees shall consist of the immediate past chair of the Tennessee Arts Commission and the previous past chair of the Tennessee Arts Commission. Further, Foundation bylaws Article VIII provides that "the Executive Director of the Tennessee Arts Commission shall serve as staff support to the corporation. The Executive Director shall manage the day-to-day operations of the foundation and shall be authorized to represent the Foundation on all matters involving board policy or in the implementation of board action unless otherwise provided by these bylaws. The Executive Director shall be removed if removed as Executive director of the TN Arts Commission." Schedule A, Part IV, Section E, Line 1c Schedule A, Part IV, Section E, Line 1c - The Tennessee Arts Commission is a governmental entity created by Tennessee Code Annotated section 4-20-101. The Tennessee Arts Foundation provided support to the Tennessee Arts Commission as described in 2023 990EZ Part III "Statement of Program Service Accomplishment."
