<ExplanationTxt>Philippine American Chamber of Commerce of Texas (PACCTX) To Whom It May Concern: The Philippine American Chamber of Commerce of Texas (PACCTX) respectfully requests relief from any penalties associated with the late filing of its annual information return because the delay was due to reasonable cause and not willful neglect. Since its founding, PACCTX has consistently sought to comply with all federal filing requirements. The organization has historically filed its annual information returns on time, and this is its first late filing. PACCTX is a nonprofit organization administered entirely by volunteer officers and directors who receive no compensation for their service. Like many volunteer-led nonprofit organizations, the Chamber depends upon its officers to fulfill administrative and regulatory responsibilities in addition to their professional and personal obligations. For many years, the Chamber's founder has voluntarily coordinated the preparation of the organization's annual IRS information return. During the filing period for the current return, he was in the process of relocating his residence from Texas to California. This major transition involved significant personal and logistical responsibilities, including moving his household, transferring records, and establishing a new residence. During this period, an unintentional breakdown in communication occurred between the founder, the Treasurer, and other officers regarding responsibility for preparing and submitting the return. As a result, the filing deadline was inadvertently overlooked. The failure to file timely was not intentional and was not due to willful neglect. Rather, it resulted from an isolated administrative oversight during an unusual leadership transition. At no time did the organization intend to disregard its filing obligations or delay compliance with IRS requirements. Immediately upon discovering the oversight, PACCTX gathered the necessary financial information, completed the required return, and submitted it as quickly as possible. The organization owed no federal income tax, and therefore the late filing did not result in any loss of tax revenue to the United States Treasury. The delay affected only the timing of the required informational filing. Recognizing the importance of preventing similar situations in the future, PACCTX has strengthened its internal administrative procedures. The organization has adopted a formal compliance calendar to monitor all federal and state filing deadlines, assigned responsibility for tax compliance to multiple officers rather than relying on a single individual, improved communication and documentation among the Board of Directors and Treasurer, and will utilize professional tax preparation assistance whenever appropriate. These measures are intended to ensure timely compliance with all future filing obligations. PACCTX respectfully submits that these circumstances demonstrate that the organization exercised ordinary business care and prudence under unusual conditions and that the late filing resulted from reasonable cause rather than willful neglect. In light of the Chamber's history of compliance, its volunteer leadership, the unforeseen disruption caused by the founder's interstate relocation, its prompt corrective action upon discovering the oversight, the absence of any tax liability, and the implementation of enhanced internal controls, the organization respectfully requests that the Internal Revenue Service abate any penalties associated with the late filing. Thank you for your consideration of this request. Should additional information be required, PACCTX will promptly provide any documentation necessary to assist in your review. Respectfully submitted, Primitivo Pagayon, Vice President Philippine American Chamber of Commerce of Texas</ExplanationTxt>
