Our CPA did not do his job and submit the 990 for the Jul 1, 2021 - Jun 30, 2022 period and then closed his business. For years, he had prepared and submitted our 990s successfully and on time for us. He prepared this missing 990 and said he submitted it through e-file in November 2022. When it was discovered in December 2022 that it was missing from IRS, I went to his office and he again attempted to submit through electronic submittal. This was his first year for him to submit a 990 electronically and we were told that he had succeeded and our 990 was appropriately submitted. He closed his CPA practice by the end of the month, December 2022. Our files were handed off to his previous partner who was then opening his own CPA business. Shortly after accepting our files and our business, this second CPA stopped answering calls, going to his office, or performing his CPA duties and his doors were locked with our files in his office and no access. Just recently, over a year later, we finally gained access to some of our files, this 990 was one of the only documents we received. That now made it possible, using an e-file provider, for us to enter the contents from the 990 hardcopy the original CPA had prepared. For the longest time, we did not know the 990 was missing from IRS. Once we did discover it, we worked incessantly to reach our second CPA to have him rectify the situation. He had our financial records so we could not recreate the 990 without access to his office and he had the already prepared 990. We even tried to find a different CPA to prepare this 990 from scratch but the absence of our records made it impossible to find someone to do so. As our CPA, we were reliant on the second CPA to prepare all financial reports and prepare and submit all filings. Please remove penalties and fees for reasonable cause for late filing.
