MWBI distributes funds and gifts-in-kind by fundraising affiliates located in countries across the world. MWBI receives cash contributions and in-kind contributions from fundraising affiliates in Australia, Belgium, Canada, Denmark, Germany, Holland, New Zealand, Norway, South Africa, Switzerland, the United Kingdom, and the United States. MWBI depends on the generous support of donors of its fundraising affiliates to support its mission and programs. Internal Revenue Code Regulation Section 1.170(A)-9(f)(3) lists several criteria which indicate facts and circumstances supporting an organization's continued public charity status despite not meeting the 33 1/3 support test. These criteria are as follows: 1. Percentage of financial support - MWBI's public support percentage exceeds 21%. The higher the percentage of support above the 10% requirement of paragraph (f)(3)(i) of 1.170A-9, the lesser the burden of establishing the publicly supported nature of the organization through other factors described in (f)(3), while the lower the percentage, the greater the burden. MWBI's support percentage is low because it receives its support from its international fundraising affiliates who do not qualify as publicly supported organizations under section 170(b)(1)(A)(vi) without a foreign equivalency determination. The support from the international fundraising affiliates was originally contributed by a broad base of individual donors from around the world who donate to the respective international fundraising affiliate in their home country. This factor is considered significant in regulation 1.170A-9. 2. Sources of support - MWBI's primary sources of support from charitable contributions over the past 60 years has come from its 11 international fundraising affiliates around the world, not from a few large donors. 3. Availability of public facilities or services and public participation in programs or policies - MWBI programs such as Children in Community, Child in Institutions, and other childcare activities touch the lives of thousands of children living in institutions and in the local community. Orphaned, abandoned, or handicapped children in institutions receive food, clothing, school supplies, go to summer camps, vocational training, are taught life skills, and receive emotional support. Each of these factors provides significant evidence of the publicly supported nature of MWBI.
