The tax exempt purpose of the Organization and the nature in which it operate are described in Note 1. Management's assertion is that there are no uncertain tax positions and the Organization continues to operate in compliance with its tax-exempt purpose. The National Association of Spine Specialists performs certain lobbying activities. Expenditures for lobbying activities are subject to a 35% proxy tax unless membership dues and assessments clearly identify the estimated portion of non-deductible membership dues which represent lobbying expense. For 2021, the Association estimated and identified to its members the portion of its dues relating to non-deductible lobbying expenses. As such, no provision for proxy tax has been made for 2021. The Organization's annual informational and income tax returns filed with the federal and state governments are subject to examination generally for three years after they have been filed. The Association reimburses NASS and payroll expense is reported on page ten of the 990. The Association does not issue any W-2s or file payroll tax returns as this is handled by the NASS. During 2021, there were four employees that worked for the Association.
